WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
1. Acknowledgment of Risks
I, the undersigned, acknowledge that participation in any activities involving firearms — including but not limited to instruction, handling, live-fire shooting, range use, cleaning, transportation, and competition — involves inherent and serious risks of personal injury, property damage, or death.
These risks may result from my actions, the actions of others, or equipment malfunction, as well as environmental conditions beyond the control of M&B Guns & Ammo LLC. I understand and accept that firearms are inherently dangerous, and strict compliance with all safety rules and instructor commands is required at all times.
2. Voluntary Participation
I certify that my participation in any firearm-related activities offered by
M&B Guns & Ammo LLC is entirely voluntary, and I am participating of my own free will.
I further understand that I may withdraw from any activity at any time, but my presence on the premises or participation in any program remains entirely at my own risk.
3. Assumption of Risk
I voluntarily assume full responsibility for all risks of injury, loss, or damage that may occur as a result of my participation or presence at any M&B Guns & Ammo LLC activity, whether foreseeable or not, including but not limited to:
- Accidental discharge or ricochet
- Hearing damage or burns
- Equipment malfunction or misfire
- Negligence of other participants or staff
- Environmental hazards (weather, terrain, etc.)
- Emotional distress or psychological trauma
4. Firearm Safety Rules and Violations
Firearm safety is the top priority at M&B Guns & Ammo LLC. All participants must know, understand, and strictly follow the four fundamental rules of firearm safety:
- Always treat every firearm as if it were loaded.
- Never point a firearm at anything you are not willing to destroy.
- Keep your finger off the trigger until your sights are on target and you are ready to shoot.
- Be sure of your target and what is beyond it.
Additionally, all range-specific rules, briefings, and commands issued by Range Safety Officers (RSOs) or Chief Range Safety Officers (CRSOs) must be followed immediately and without question. These rules are designed to protect all participants and staff.
Safety Violation Policy
Firearm safety violations are considered extremely serious. Any unsafe act, disregard for safety instructions, or willful misconduct will result in immediate course termination and removal from the range, with no refunds provided. Depending on severity, the participant may also be permanently prohibited from future courses or range activities.
Chief Range Safety Officers have final decision-making authority regarding all matters of safety, conduct, and course participation. Their decisions are final, binding, and non-negotiable to maintain a safe environment for all involved.
5. Training, Testing, and Course Completion Policy
M&B Guns & Ammo LLC courses may be conducted in both classroom and live-fire range environments.
Classroom Courses:
Students are expected to participate in discussions, demonstrations, and written assessments as part of their training.
Live-Fire Courses:
These sessions may include range qualification tests and target evaluations that require participants to achieve a minimum passing score to successfully complete the course and advance to higher levels of instruction.
Testing & Retakes:
Students are permitted one (1) retake of a written or range qualification test at no additional charge. Any additional attempts must be rescheduled for a later date and are subject to a standard retest fee.
Not all courses have a test or a minimum range qualification score
— The specific training program determines course requirements.
Range Target Testing:
When possible, target retests may be completed on the same day, time permitting. If the schedule does not allow, they may be rescheduled for a later date for a small administrative fee.
By signing this agreement, I understand that successful completion of any M&B Guns & Ammo LLC course is contingent upon meeting all required safety, performance, and qualification standards.
6. Release and Hold Harmless
In consideration for being permitted to participate in activities hosted or supervised by M&B Guns & Ammo LLC, I hereby release, discharge, and hold harmless:
M&B Guns & Ammo LLC, its owners, officers, instructors, Chief Range Safety Officers, agents, employees, volunteers, affiliates, successors, and assigns from any liability, claims, demands, actions, or causes of action related to any loss, damage, or injury (including death) that may occur as a result of participation, whether caused by negligence or otherwise.
I further agree to indemnify and defend M&B Guns & Ammo LLC and its representatives against all claims or legal actions arising from my conduct while participating in or observing any activity.
7. Medical Fitness
I affirm that I am in good physical and mental health and have no condition that would endanger myself or others during firearms-related activities. If I require medical attention, I authorize M&B Guns & Ammo LLC or its representatives to seek emergency medical assistance at my expense.
8. Legal Eligibility
By signing this agreement, I affirm that:
- I am at least 18 years of age (or participating with written guardian consent).
- I am not prohibited by law from possessing or using firearms.
- I am not under the influence of alcohol, drugs, or any impairing substances.
- I have not been convicted of a felony or any offense that disqualifies me from firearm ownership.
9. Photo & Media Release (Optional)
I grant permission to M&B Guns & Ammo LLC to use photographs, videos, or other media of me taken during training or events for promotional or educational purposes, without compensation.
10. Acknowledgment of Understanding
I HAVE READ AND UNDERSTOOD THIS WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT, INCLUDING THE FIREARM SAFETY, COURSE COMPLETION, AND CRSO AUTHORITY POLICIES. I FULLY UNDERSTAND THAT BY SIGNING BELOW, I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND THAT I SIGN THIS AGREEMENT VOLUNTARILY AND OF MY OWN FREE WILL.
